These Terms of Service (“Terms“) govern your access to and use of klaravex.com and all services provided by Klaravex LLC (“Klaravex“, “we“, “us“). Please read these Terms carefully before using our services.
1. Acceptance of Terms
By accessing klaravex.com, using any Klaravex service, or engaging us in a service relationship, you agree to be bound by these Terms and our Privacy Policy. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization.
If you do not agree to these Terms, do not use our services.
2. Services
Klaravex provides the following services:
- Managed IT Services (B2B): Ongoing technology support, infrastructure monitoring, security advisory, and strategic IT consulting for businesses
- Consumer Remote IT Support: Per-incident remote troubleshooting and technical assistance for individuals
- Klaravex AI AI Support: AI-powered first-line support assistant available via the Klaravex portal
- Career Services: Resume writing, LinkedIn profile optimization, cover letter creation, and interview preparation
- Knowledge Base: Publicly available technical guides and informational content at klaravex.com
The specific scope of any B2B engagement is governed by the signed engagement letter or Master Service Agreement entered into between Klaravex and the client. In the event of conflict between these Terms and a signed agreement, the signed agreement controls.
3. AI Support — Klaravex AI
Klaravex AI is Klaravex’s AI-powered support assistant. By using Klaravex AI, you acknowledge and agree to the following:
- Klaravex AI is an AI assistant, not a human. Klaravex AI will identify itself as an AI. Do not assume you are communicating with a human technician unless a human engineer has joined a session and identified themselves.
- Informational nature: Klaravex AI’s responses are informational guidance based on the context provided. For critical infrastructure decisions, production system changes, or decisions with significant business impact, human review by a qualified technician is recommended before proceeding.
- Scope limitations: Klaravex AI does not provide legal, financial, medical, or compliance advice. Any content that resembles such advice should not be acted upon without consulting a qualified professional.
- Liability for Klaravex AI output: Klaravex is not liable for decisions made solely on the basis of Klaravex AI’s output without human review, particularly for changes to production systems or critical infrastructure.
- Data handling: Conversations with Klaravex AI are processed as described in our Privacy Policy, Section 5.
4. Consumer IT Support
Remote-Only Service
Consumer IT support is provided remotely via screen-sharing and remote access tools. Klaravex does not provide on-site visits for consumer support engagements.
Pricing & Payment
Consumer support is priced on a per-incident basis. Charges are collected after the issue has been resolved. If your issue cannot be resolved during the session, you will not be charged for that session. Pricing is published at klaravex.com/personal/pricing/.
Scope & Limitations
Klaravex does not guarantee resolution of all issues. Some problems are outside the scope of remote support, including:
- Hardware failures requiring physical repair or replacement
- Data loss beyond recovery capability at the time of service
- Third-party platform outages (ISP, cloud services, software vendor systems)
- Issues requiring software licenses you do not hold
Session Consent
Remote sessions require your active participation and informed consent to access your screen and systems. You may terminate any remote session at any time by closing the session from your end. Klaravex technicians will not access any system, file, or application beyond the scope required to resolve your issue.
5. Career Services
Deliverables
Career services packages include written deliverables as specified at time of purchase — typically a professionally written resume, LinkedIn profile content, and cover letter template(s). The exact deliverables are defined in the package description at the time of order.
Interview Guarantee
We offer a revision guarantee for career services: if you do not receive an interview invitation within 60 days of receiving your final deliverables, and you have:
- Applied to 5 or more relevant roles per week using the provided materials
- Applied to roles for which you meet the stated qualifications
- Used the provided resume and LinkedIn content without material modification
…we will provide one free revision pass of your materials. This is a revision guarantee only, not a refund guarantee. We do not guarantee employment outcomes, compensation levels, or specific hiring decisions.
Your Responsibility
Career services are based on information you provide. You are responsible for the accuracy and completeness of the information you supply. Klaravex is not responsible for the accuracy of credentials, experience, or other representations in your materials — those remain your responsibility.
6. Payment Terms
All fees are as published on klaravex.com or as specified in a signed engagement letter or service agreement.
- Payment method: All payments are processed via Stripe (credit and debit cards). We do not accept cash, checks, gift cards, wire transfers, or cryptocurrency.
- Consumer services: Payment collected after issue resolution (per-incident) or at time of order (career services packages).
- B2B managed services: Net-15 invoicing from invoice date unless otherwise specified in the engagement letter. Late payments may incur interest at 1.5% per month.
- Disputed charges: Contact hello@klaravex.com before initiating a chargeback. We will work to resolve billing disputes promptly.
7. Intellectual Property
Klaravex IP: All rights in Klaravex AI, Klaravex’s internal tools, methodologies, processes, and website content are owned by Klaravex LLC. Nothing in these Terms grants you a license to use Klaravex’s intellectual property except as necessary to use the services.
Client IP: You retain all ownership of your data, systems, code, and content. Klaravex’s access to your systems in the course of providing services does not transfer any ownership rights to Klaravex.
Career services deliverables: Upon receipt of full payment for career services, you own the final resume, LinkedIn content, and cover letter materials delivered to you. Klaravex may retain anonymized samples for portfolio purposes unless you request otherwise in writing.
8. Confidentiality
Both parties agree to maintain the confidentiality of non-public information received from the other party in connection with these services (“Confidential Information“).
Klaravex will not disclose your system architecture, infrastructure details, business information, or technical configurations to third parties except as required to deliver the agreed services (e.g., providing relevant context to a sub-processor). This obligation survives termination of the service relationship.
The confidentiality obligation does not apply to information that: (a) is or becomes publicly known without breach of this obligation; (b) was known to the receiving party before disclosure; (c) is required to be disclosed by law or court order; or (d) is independently developed without use of Confidential Information.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KLARAVEX’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO KLARAVEX FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRIOR TO THE DATE THE CLAIM AROSE.
IN NO EVENT WILL KLARAVEX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, BUSINESS INTERRUPTION, SYSTEM DOWNTIME, OR COSTS OF SUBSTITUTE SERVICES, EVEN IF KLARAVEX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, some of the above limitations may not apply to you.
10. Disclaimers
Knowledge base content and Klaravex AI responses are provided on an “as is” and “as available” basis without warranty of any kind, express or implied. Klaravex does not warrant that:
- Klaravex AI’s responses are error-free, complete, or current
- Knowledge base articles apply to your specific situation without modification
- IT security measures implemented through our services will eliminate all security risk
Security measures reduce risk but do not eliminate it. Klaravex recommends maintaining your own backups, incident response plans, and layered security posture independent of any services we provide.
11. Acceptable Use
You agree not to use Klaravex’s services or Klaravex AI to:
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to systems you do not own or have explicit permission to access
- Transmit malware, spam, or harmful code
- Circumvent security measures on third-party systems
- Harass, threaten, or harm any person
- Reverse-engineer or attempt to extract Klaravex’s proprietary methodologies or Klaravex AI’s underlying systems
Klaravex reserves the right to terminate service to any user who violates these acceptable use provisions.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of law principles.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or Klaravex’s services that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Wyoming. The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or address imminent irreparable harm without first submitting to arbitration.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page. For active clients, we will provide notice by email at least 14 days before material changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
